辺野古沖で8月２２日、海上保安庁の職員がカヌー隊の男性（３２）を押さえ付け頸椎捻挫全治10日のけがを負わせた。

8月29日、被害にあった男性は、複数の弁護士と共に海保のゴムボートに乗船していた職員３人を氏名不詳のまま、特別公務員暴行陵虐致傷罪で那覇地検名護支部に告訴状を提出した。

On August 22th, Japan Coast Guard person violently grabbed a 32 year old canoe activist by the neck, which resulting in cervical sprain that would take 10 days to recover.

On August 29th, the 32 year old man along with his lawyers submitted a complaint to Naha Local Prosecutors' Office Nago Branch for crime of violence and humiliation resulting in injury.

A non-violent canoe activist was grabbed by his neck violently by Japan Coast Guard person.

非暴力で反基地運動をしていたカヌー活動家が海保の人員に暴力的に首をつかまれる。

ちなみに暴力をふるった海保の人員は、以前にも眼鏡を書けた反対市民をわざと眼鏡の上から強く押さえつけ、目の横が流血したと言う暴力も振るったことがあるそうです。

The same Japan Coast Guard person is known to have done another violent act against an anti-base citizen before.  The guard pressed a citizen grabbing his glasses onto his face, which lead to bleeding, according to local people.

 

The canoe activist was diagnosed as "cerevrel sprain which would take 10 days to be recovered" at the hospital he went on the same day.

その後、病院で全治10日間の頸椎捻挫と診断。

Takenouchi: 8月23日、辺野古で大変な事件が発覚しました。カヌーで基地反対で非暴力的に抗議していた人が、海上保安庁の人員にゴムボートに暴力的に載せられ、頸椎をねん挫してしまったと言う事件が発生し、沖縄で大きなニュースになっています。

On August 23rd, a big incident took place in Henoko.　 A non-violent canoe protestor was injured by Japan Coast Guard person which became a big news.  (Okinawa Times, Aug 23, 2014)

彼が今目の前におりまして、残念なことに彼は頸椎をねん挫しています。
何が起きたか教えて下さい。

He is just in front of me and unfortunately, he has been suffering from cerevral sprain.
Please tell me what happened.

男性：僕はカヌーに乗って今ボーリング調査が行われている現場で、抗議活動を行っていました。

The man: I was doing opposition campaign on the canoe boat against drilling survey implemented at Bay of Oura, in Henoko on that day.

それで海保のゴムボート2隻が僕のカヌーにやってきて、はさみました。

Then 2 Japan Coast Guard rubber boats came to my boat and sandwitched my canoe.

それから海保の人が僕のカヌーを鍵棒で僕のカヌーを引き寄せました。

Then the personnel pulled my canoe boat using an iron bar.

それで彼らは僕に対する令状があるわけでも法的根拠も示さないまま、ゴムボートに引き上げようとしました。

And without any warrant or any legal backgroud, they tried to pull me into the rubber boat.

次の瞬間、一人が僕に馬乗りになって、羽交い絞めにしながら、強制的に暴力的にゴムボートに載せました。

Next moment, one man was horseriding me and grabbed me violently and pulled me into the rubber boat forcibly and violently.

ボートに乗った瞬間に僕は首の痛みを感じて、その保安官に首が痛いから押さえつけないでくれと言いました。

Then I felt pain in my neck and so I asked them, "Please hands off, since I am feeling pain."

それで僕はゴムボートに載せられたんですが、僕は「痛い」と言っていたのに、その保安官は、「抵抗するな」と言って、ぼくをまた押さえつけました。

Thus I was in their rubber boat, and though I made no resistance, the guard told me, "Do not resist!" and grabbed me down once again.

それで僕がもう抵抗しない状態になっているのに押さえつけられている時、その瞬間マスコミがこれを撮影していてくれないかなと考えました。

I was not resisting or anything, but the guard kept grabbing my neck.  At that time I was praying some media person was taking photo of them.

するとカメラマンを載せたマスコミの船がやってきて、写真を撮り始めました。
Then a media boat carrying a camera man approaced us and started to take photoes.

僕はその現場で起きていることを全てカメラに収めてほしいと思いました。

I hoped that the person would take the photoes of what was going on at that time.

すると保安員はカメラで写している間は、僕に対して大丈夫かとジェスチャーし、またその船がいなくなると僕を強く押さえつけてきました。それが2回ほど続きました。

When the media boat was approaching, then the guard patted me gesturing, "Are you OK?" and when the media boat was away, he started grabbing me strongly again.  The same thing happened two times.

それでカメラがいない時に、その保安官は僕に言いました。「カメラに映っていないから、痛くないだろう？」と。

When the media boat was away, the guard said to me, "Now the camera is gone, so you should not feel any pain."

僕はその時、この保安官は、「僕が嘘を言っている」ということをもって、言っているように思いました。

I thought that the guard was saying as if I was telling lies.

竹野内：ああ、「嘘を言っているように」という事ですね。

Takenouchi: You mean, he said that as if you were lying

(ここでなぜか音声がおかしくなった！

竹野内の説明： つまりこういうことですね。海保の人は、彼が実は首が痛いなんてことはないんだけれどもお芝居をしているかのように状況を見せたがっていたという事ですね。

So the thing was like this. Japan Coast Guard man was trying to make look the situation as if he was not feeling any pain, but he was pretending and he was acting as if he had pain in his neck.


海上保安庁の保安官は嘘をついていました。僕は本当にかなり首が痛かったし、彼は実際にその時、僕の首を暴力的に押さえていました。

But actually he (the Japan Coast Guard person) was telling a lie.  I was feeling tremendous pain in my neck during that time. He was actually violently holding my neck.

その後、僕はゴムボートに載せられ、尋問を受けました。

Afterwards, I was taken away by the rubber boat and I was questioned by them.

彼らは法的根拠もなく尋問してきたので、名前や住所を聞かれても、僕は黙秘しました。

They did questioning without legal background, so I was keeping my silence not telling my name and address.

するとその海保の人は、僕を特別な巡視船に連れて行ってやると言うのです。

Then the Japan Coast Guard man told me that he will take me to the special patrol boat
(translator's note:  I took the wrong word  "Fleet" but he meant he was about to be taken into a "patrol boat.")

僕はその人に、仲間のカヌーの人達と出発した浜に連れ戻してくれるよう頼みました。

I asked the man to take me back to the beach I started with other canoe men.

そしてその浜辺に連れ帰ってもらいました。解放される前に、私は自分を暴力的に押さえつけた人物に言いました。

They finally took me back to the beach we started.  Before I was released, I told the man who violently held me.

暴力をした彼の方に僕が質問をしたのです。「貴方の名前と肩書を教えて下さい」と。
すると今度は彼の方が黙秘しました。

I asked the violent man, "Please tell me your name and title."  When I asked questions, he kept silence.

彼は答えませんでした。そこで僕は同じ質問をしました。

He was not answering, so I asked the same question once again.

そして僕は聞きました。「なぜ黙秘するのですか？そしてなぜ僕を不当に拘束するのですか」

So I asked him "why are you keeping silence?  Why are you keeping me as in an unjust way?"

すると彼の方は僕にこう聞いてきました。「また沖合の方に連れ帰ってもらいたいのか？」

Then he asked me, "Would you like to go back to the off shore once again."

彼の口調はあたかも沖合に出てまた暴力的な行為をしてやろうかというように聞こえました。

He was as if he would take me off shore and would do the violent things once again.

そこで僕は人のたくさんいる人のあまりいない浜や沖合よりも、仲間がもっといる辺野古の漁港の方に連れて行ってくれと頼みました。

So I asked him to take me to the fishing's port with more people watching rather than the remote beach or remote off shore.

漁港につくと彼の態度は一変して、非常におとなしい態度になっていました。

He finally took me to the fishing port.

When we arrived at the fishing port, he was very quiet and he became very gentleman-like. His attitude totally changed.

僕たちの仲間が不当に拘束したことを追及して、「なぜ拘束するのか、名前と肩書を言ってくれ」と言いました。

My commrades asked him, "Why did you capture him?  Please tell us your name and position."

しかし彼は同じように全く何も答えませんでした。

But again, he did not answer anything.

僕は最後まで追及したかったのですけれど、でも答えなかったので、結局ゴムボートを降りました。

I really wanted to get his answer, but since he didn't answer any, I got off from the rubber boat.

それで僕はその後に状況と自分の体調を仲間に報告したところ、仲間から病院に行った方がいいと言われ、病院に行きました。

I told my commrades about what had happened and my problem, they suggested me to go to hosptal.

病院に直行すると、診断結果は頸椎捻挫、全治10日という診断が下されました。

So I went to the hospital right away and the doctor diagnosed me that I had cervical sprain which would take for 10 days.

僕としては診断結果が出たと言う事で、今現場で起きたことを社会に対して訴えたいと、マスコミにも話しました。

Since I got the diagnosis and wanted to tell the public what had happened at the site, I told the story to media people.


次の日の朝刊に、海保の保安官が暴力をふるっている写真を見て、改めて酷いと思いました。

On the following morning, I saw my photo being attacked by the Japan Coast Guard man and I had the renewed feeling that it was horrible.

僕はこの問題を徹底的に明らかにして追及したいと思っています。

I really want to throughly find out the facts and pursuit this case.

この問題は沖縄の辺野古への基地を移設すると言う事が、安倍政権の下で強権的に行われていることを示す事象の一つであるからです。

This case is a very good example of Abe regime's high-handed political tactics to relocate Futenma air base to new Henoko base.

多くの沖縄の人々は普天間基地を閉鎖して、辺野古に新しく基地を作ることは大きく大きく反対しています。

Majority of Okinawan people are against the construction of new base at Henoko after closing Futenma.

にもかかわらず、昨年末に仲井真知事が埋め立て申請を許可すると言う事がありました。

However, Mr. Nakaima, the governor of Okinawa, admitted the application for reclaiming the Henoko Sea at the end of last year.

本当に、人類の中でも長年の戦いによって勝ち取られた民主主義が否定されていると思います。

しかも時の政権が暴力的に決定を変えることができると言う事に対しての挑戦であると思います。

首を治療してなるべく早くコルセットを外せるようにしてカヌーの仲間たちの所に戻りたいと考えています。

Post Script by Mari Takenouchi

暴力をふるった人物の詳細は知りませんが、この人物は本土出身の人物で、以前にも、反対する市民をわざと眼鏡の上から強く押さえつけ、目の横から流血してしまったと言う事件も起こしているそうです。

I do not know the details of this person, but local people told me that he had done another violent act against another protester who was wearing glasses.  The protester was captured by him who purposely pressed him hard above his glasses, and the protester suffered bleeding from the side of his eye.

一方、被害にあわれた彼は非常にまじめでしかも優しい30代前半の男性。

On the other hand, the person injured this time was a man in his early 30s and he was quite sincere and gentle.

学生のころから、発展途上国の経済格差の問題やアジア諸国への侵略問題、戦後補償の問題、従軍慰安婦の問題で活動されていたそうです。
（私も従軍慰安婦問題を手伝っていたことがあるので嬉しかったです。）

He told me that he was doing some studies/activities in pursuing the  responsibilities of Japan during the war of agression, insufficient post-war compensation, comfort women issue, and economical gaps on developing nations.
(Since I was also working on comfort women issue, I was happy to see our common points.)

彼は日本の加害責任もしっかり追及しなければならないと強調。（まったく同感）

He stressed that we need to focus more on Japanese responsibility as perpetrators against Asian nations. (I totally agree with him!)

またうちの4歳の息子もinterview前後で可愛がってくれ、「首が痛いのだから無理をしないでください」と言っても遊んでくれ、息子もなついて大喜びでした。。。

He was very nice to my 4 year old son before and after the interview, and though I asked him, "Please never mind my son since your neck is injured," he was playing with my son.  My son was deligted and loved him!

Post Script 2

現在、私のツイッターは何者かに操作されており、私のフォロワーは不自然な直線を描いて減らされています。そして何人も私のツイートがRTできない時があると報告してくれました。

Currently, my twitter is controlled by someone and the number of followers are constantly decreasing in an unnatural straight line...and my tweets cannot sometimes be RTed according to some people who report me.

同様に、私のiphoneもおかしな動きを見せます。上のように音声が急に小さくなったり普通に戻ったりするのです。当日、私のビデオのバッテリーが上がってしまい、iphoneを使っていましたが、彼の最後のセリフの時にバッテリーがあと２０％と表示されていたのにもかかわらず、途中で音声がほとんど消えてしまったり、復活したりしています。。

Likewise, my iphone seems to be behaving strangely with the sound suddenly becoming small or getting back to normal.  On this day, my video camera's battery was gone, so I was using my iphone...

Though 20% of the battery remained at the time when he said the last line, the sound system almost died away in the middle and then recovered...very strange...




ちなみに上の動画はこの事件の現場を24秒映したものです。Youtubeで見ると、ノーグッドを押している人たちがたくさんいます。どういう意味なのでしょうか。私も自分の息子が動物と遊んでいる動画にまでノーグッドをたくさん押す人がおり、憤りを感じております。

Prime Minister Abe's fund management organization, "Shinwakai" has allegedly made false records on the political donation balance sheet, which lead to the criminal charge by University professors on August 18th.

  　告発したのは、醍醐聡・東大名誉教授をはじめとする4人で、晋和会の会計責任者を虚偽記載で、また、安倍首相に対しては、会計責任者の選任と監督について相当の注意を怠ったとして、それぞれ東京地方検察庁に告発した。

 

The accusers are four people including Tokyo University Professor Emeritus Mr. Satoshi Daigo.

 

They accused against Shinwakai's accountant for falsified records and Prime Minister Abe for considerable negligence of supervision respectively to Tokyo Local Prosecutors' Office.

  　醍醐氏が自身のブログで明らかにしたところによると、告発に至ったのは、週刊誌「サンデー毎日」が今年7月に掲載した記事が発端。

Mr. Daigo said that he decided to accuse them by reading the article of weekly magazine Sunday Mainichi in July.

  「NHKプロデューサーが安倍首相に違法献金疑惑」と題した記事の中で、NHKのチーフプロデューサーによる献金が、報告書では会社役員と記載されていたことなどを問題視した内容となっている。

 

In the article titled, "Suspicion of illegal donation to Prime Minister Abe by NHK chief producer," the donation from the NHK chief producer was described as "from a company executive," which lead to the controversy.

I once heard a horrible story that a politician whose unjustifiable acts were about to be spotlighted was delighted to know that Fukui Great Earthquake (1946) took place which erased his scandal.

今、安倍首相とNHKが広島での土砂災害の悲劇を、自らの不正隠蔽に利用していないと言い切れるだろうか。

Now there is no coverage of Prime Minister Abe and NHK scandal.  Isn't it possible that both PM Abe and NHK are using the tragedy of Hiroshima landslide for hiding their own scandals?

　昨日、私を含む4名は、安倍晋三首相の資金管理団体「晋和会」が総務大臣に提出した2011年分、2012年分の政治資金収支報告書に虚偽記載があったと判断し、8名の弁護士を代理人として、晋和会の会計責任者××××氏を政治資金規正法第25条1項3号（政治資金収支報告書の虚偽記載）で、同会代表者の安倍晋三氏を同法同条第2項（会計責任者の選任と監督に係る注意義務違反）で、それぞれ東京地方検察庁に告発した。

 

On August 18, four persons including myself with 8 representing lawyers submitted the accusation to Tokyo District Public Prosecutors' Office against Shinwakai (the fund management group for Prime Minister Abe) for falsified record of  2011 and 2012 political fund balance sheet that had been submitted to the Minister of Internal Affairs and Communications, and against Prime Minister Abe, the representative of Shinwakai, for violation of duty of care.

　告発に至った経過 Process prior to the accusation

 

　本件の発端は、安倍首相の資金管理団体「晋和会」がNHKの一職員（チーフプロデュ－サ－・小山好晴氏）から2011年、12年に受け取った寄附を、「NHK職員」という身分を隠し、「会社役員」からの寄附と偽って記載をしていた事実を『サンデー毎日』7月27日号が報道したことにある。

 

It all started with the article of July 27 issue of the weekly magazine Sunday Mainichi that revealed the fact that Seiwakai falsified the record of the donation in 2011 and 2012 with Mr. Yoshiharu Koyama, the NHK chief producer who described his status as "company executive" hiding his real status.

　私は、この件で同誌から取材を受け、問題の所在を知ることになった。同誌にも記載されているが、晋和会は、『サンデー毎日』から小山好晴氏の献金について取材を受けた日（本年7月10日）の翌日、小山氏および同氏の妻・小山麻耶氏の職業を「会社役員」から「会社員」に変更済みと回答したという。しかし、小山好晴氏の職業は「NHK職員」または「団体役員」とするのが正しいから、「会社員」と記載することも、なお虚偽記載である。

 

I was interviewed for this issue and came to be aware of this problem.  As was written in Sunday Mainichi, on July 10th, the following day of the interview by Sunday Mainichi, Shinwakai said that they corrected the description from "company executive" to "company worker" for Mr. Koyama and his wife Mrs. Maya Koyama.

 

However, the correct description of Mr. Oyama should be NHK staff member or corporation executive, so the renewed description of "company worker" is still a falsified one.

　ところで、本件を調査していく中で、総務省のHPに掲載されている「晋和会」の2011年分、2012年分の「収支報告書」を閲覧していくと、7月18日付で寄附者の職業名が多数箇所にわたり、再度、訂正されていることがわかった。

 

During our investigation on the 2011 and 2012 Shinwakai balance sheet listed on the URL of Ministry of Internal Affairs and Communications, we found out that many descriptions on the donators' occupations were modified on July 18th.

　合計16箇所（2年分につき重複を除くと9名分）に及ぶ寄附者の職業名の訂正の中には、著名な作曲家を当初「会社役員」としていた例や、「会社役員」を「無職」と訂正した例、「会社役員」を「弁護士」と訂正した例などが含まれていた。こうした訂正がなされたこと自体、晋和会の政治資金収支報告書がいかにずさんなものであったかを物語っており、政治資金規正法第27条第2項が定めた重過失による虚偽記載に該当すると判断される。

Among the 16 modified occupational desctiption (excluding the same persons, 9 people's occupation titles during 2 years), there are examples where famous composer was written as company executive, or company executive corrected as "no occupation," company executive modified as "lawyer." 

These kinds of modification themselves show how Shinwakai's political fund balance sheet is flawed one, which should be applicable for the falsified descritption with serious negligence stipulated in Clause 2, Article 27 of the Political Fund Regulation Act.

　また、NHKのチーフプロデュ－サ－の職業を「会社役員」「会社員」と記載したのは寄附者の実の職業を隠蔽する意図を強く推定させるものであり、刑法第38条第1項が定める故意犯に該当する可能性が高い。

　そこで、前記4名は晋和会の会計責任者××××氏を政治資金規正法第25条1項3号（政治資金収支報告書の虚偽記載）で、同会代表者の安倍晋三氏を同法同条第2項（会計責任者の選任と監督に係る注意義務違反）で、それぞれ東京地方検察庁に告発するに至ったのである。

 

In addition, it is strongly suspected that there was an intention to hide the real occupation of the donator by describing the NHK Chief Producer as "company executive" and then "company worker," which may be applicable to an intentional crime specified in paragraph 1 of Article 38 of the Criminal Codes.

 

Therefore, the four perople came to the conclusin to submit the accusation to Tokyo District Public Prosecutors' Office against Mr. X, the accused accountant of Shinwakai for violating Item 3, Paragraph 1, Article 25 of Political Fund Control Act (falsified description on political fund balance sheet) and against Prime Minister Shizo Abe for violation Paragraph 2, Article 25 of the same Act (Selection of the responsible accountant and the violation on duty of care on supervision) .

　「たかが肩書の誤記を何で」という議論がある。しかし、例えば、国政情報センター編著『政治資金規正法違反事例集』（2012年、国政情報センター刊）を調べると、「国交省関係者らから寄附を受け、職業を『会社員』と記述」したことが違反事例の一つとして取り上げられている（82～83ページ）。この事例は参議院議員A氏が代表を務める資金管理団体が2006年の政治資金収支報告書の中で、個人献金をした国交省の現役局長や外郭団体トップらの職業を「会社員」と記載していた事実を違反事例として解説したものである。

 

There are some argument such as, "What is the big deal for mistaken description of titles?"  However, when we look into the book, "Casebook on Violation against Political Fund Control Act" (National Politics Information Center, 2012), there is a case in which the donator was described as company worker in stead of an associated person of Ministry of Land, Infrastructure, Transport and Tourism (MLITT), as "a violation of the Political Fund Control Act".

 

In this case, interpretation was provided on the fact that the fund management group of Mr. A, a member of Upper Council, had described the MLITT bureau chief and affiliated organization's director as "comapny workers". 

　A氏の政治資金報告書では寄附者のほとんどの職業が「会社員」と記載されていたが、その中には、上記の現役国交省局長や同省の外郭団体の理事長のほか、旧建設省OBの市長、元技監なども含まれていたという。また、寄附者の中には、国から出資、補助金を受けていた公益法人などのトップも含まれていた。

In case of Mr. A's Political Fund Report, most of donators' occupations were listed as "company worker," but among them, there were people who were actually the incumbent bureau chief of MLITT, executive director of a MLITT affiliated organization, a city mayor who used to work for former Ministry of Construction, a former Chief Engineer of Ministry of Construction etc.

Also included were the top personnels of Public Corporations which received fund and subsidies from the government. 

　A氏は旧建設省出身で、2007年の参院選で初当選した。個人献金をした人物の多くはA氏と親交が深かった国交省関係者と見られている。

 

Mr.A used to work for the former Ministry of Construction and was elected as Upper House Councilor in 2007.  Most of the individual donators were Ministry of Construction related people who were also in close relationship with Mr. A.  

　この事例からもわかるように、寄附者の職業は、寄附者、若しくは個人を装った団体献金者と政治団体との癒着、不明朗な政治過程を国民が監視し批判するうえで重要な情報となりうる場合があるのである。

 

From this case, we can see that the occupations of the donators could become important information resource to criticize the collusion between political organization and donators/donator pretending as individuals representing corporation, and for people to watch and criticize ambiguous political procedures.

　今回の晋和会の例でいうと、「プロジェクトX」、「プロフェッショナル」、「ファミリーヒストリー」など人気を博した番組の制作に携わったNHKチーフプロデューサーが時の政権トップの政治団体に献金をした事実は、NHKの放送の政治的公正、不偏不党、自主・自律の原則を定めた「NHK放送ガイドライン」、「職員の服務準則」に反する行為であり、NHKはそうした原則を堅持しているという視聴者の信頼を失墜する行為である。

 

In this Shinwakai's case, the fact the NHK Chief Producer  who worked on popular programs such as "Project X," "Professionals," and "Family History" donated to the political group of the incumbent regime is an act which violates "NHK Broadcasting Guideline" and "Service Codes" with stipulation of political fairness, no bias on political parties, volantary/self disciplined principals, which could result in the viewers' distrust to NHK.

 

しかも、この「自主・自律の堅持」を定めた「NHK放送ガイドライン」の冒頭の節で定められた「放送の公正、不偏不党」、「信用失墜行為の禁止」、「兼職の禁止」はNHKの「全役職員」が遵守すべき規範として設けられたものである。

 

Moreover, "Fairness of Broadcast, No bias on political parties," "Prohibition of acts leadig to distrust," "Prohibition of concurrent posts" stipulated in the beginning of "NHK Broadcasting Guideline" are the rules which should be avided by "all the NHK staff with titles".

　また、NHKが定めた「行動指針」では「私生活でも公共放送の信用を損なう行為をしません」と謳っている。

In addition, "Action Guidelines" stipulated by NHK says, "We shall avoid any act which could damage the trust of public broadcasting corporation in private life as well."

　以上から、小山好晴氏の「晋和会」に対する献金はこれらガイドライン、服務準則、行動指針のいずれにも反する公算が大である。

For the reasons mentioned in the above, the donation to Shinwakai by Mr. Yoshiharu Koyama is most probably violating "NHK Broadcasting Guideline", "Work Codes," and "Action Guidelines."

　このような文脈でいうと、「晋和会」が小山好晴氏の職業を「会社役員」と偽って記載したのは小山氏の上記のようなコンプライアンス違反行為を隠蔽する故意犯に該当する可能性が高いと言わなければならない。

In this context, it is highly probable that Shinwakai's falsified description of Mr. Koyama's occupation as "company executive" could be applicable to the intentional crime hiding Mr. Koyama's aforementioned acts violating NHK compliance.

　さらにいうと、晋和会への寄附者の中にある小山麻耶氏は小山好晴氏の妻であり、麻耶氏の母は安倍晋三氏の熱烈な支援者として知られる金美齢氏である。このことからすると安倍氏、あるいは主たる事務所が安倍氏の国会事務所となっている「晋和会」の会計責任者・××××氏が小山好晴氏の実の職業を知らなかったとは考えにくい。こうした事情を勘案すると、小山好晴氏の職業を「会社役員」と虚偽の記載をした事実は故意犯に該当する可能性がいっそう強まるのである。

Furthermore, Mrs. Maya Koyama who is also a donator to Shinwakai is wife of Mr. Yoshiharu Koyama, and the mother of Mrs. Koyama is Ms. Birei Kin, a known ardent supporter of Prime Minister Shinzo Abe. 

Considering these, it is almost impossible that Prime Minister Abe and Shinwakai's accountant Mr. X did not know the real occupation of Mr. Yoshiharu Koyama and probability of this case falling under the category of an intentional crime is hightened.


後で訂正しても違法性は消えない 
Correction of the description does not erase illegality

　「すでに当事者が訂正したものを告発するのはいいがかり」という議論が見受けられる。しかし、事後の訂正は虚偽記載の罪責判断において情状酌量の要素になることはあっても、処罰の認否に影響するものではないというのが法曹界の定説であり、政治資金規正法第27条第2項後段でその旨の定めが置かれている。
　前記の政治資金規正法違反事例の解説でも、「処罰対象となるかどうかは行為を行ったときを基準に判断するため、事後に訂正しても処罰対象から逃れるというわけではない。あくまでも行為時（この場合は記載時）に故意、あるいは重過失があるかどうかが問題となる」と記されている（83ページ）。

Some argue saying, "It is a groundless accusation because the party has already made the correction." However, such follow-up correction could become an element for extenuation of circumstances on judging the criminal responsibility, but cannot affect the approval or disapproval of the punishment under the common knowledge of law, which is also stipulated in the latter half of paragraph 2 of Article 27 in Political Fund Control Act.

In the aforementioned explanation of the case violating Political Fund Control Act, it is said, "Whether the accusation becomes punishable or not is judged at the time of the conduct, so even if the correction is made afterwards, the accused cannot avoid punishment.  Whether there was any intention or serious negligence at the time of the conduct (in this case, at the time of description) shall become the issue." (page 83)

Mari Takenouchi is a Japanese freelance journalist. Since the beginning of the Fukushima nuclear disaster, it covers events and tirelessly seeks to alert the population status. Like many independent journalists, Mari Takenouchi quickly suffered multiple pressures. Reporters Without Borders also condemns regularly thereby demonstrating that these numbers are the same intimidation because of the government. A documentary called "Censored Fukushima" is also being prepared.

The intimidation culminated in January 2014 when Mari Takenouchi is prosecuted for a tweet calling the Ethos project "to experiment on human beings." This project, funded by large groups of the French nuclear industry (EDF, CEA and Areva) and already in place in Chernobyl, aims to teach people to live in contaminated areas, despite any consideration of safety.

My name is Mari Takenouchi, a radiation issue translator, freelance journalist and a single mother of 4 year old boy. 

After Fukushima accident, I have been calling for evacuation of Fukushima kids and pregnant women from contaminated area in my books, twitter and blog, and also pleaded the same to the United Nations. (But it has not worked so far...)

Currently, as many as 51 Fukushima children went through thyroid cancer surgeries and quite shockingly, most of them had metastasis on their lymph nodes or lungs. 

However, the government of Japan has totally been denying any health hazards in Fukushima, and they state instead, "Some say nose-bleeding was observed in Fukushima due to radiation. We need to control such kind of groundless rumor which damages Fukushima reconstruction." 

In January 2014, I was criminally accused for my tweets by Ms.Ryoko Ando (the real name is Yoko Kamata) the director of group called Fukushima ETHOS which encourages residents to keep living positively with dosimeter.

While no Tokyo Electric executives has ever been investigated, 3 people from Fukushima police and 2 people from Fukushima prosecutor's office came all the way to Okinawa for my investigation and I got a deferred indictment, which means I could be a criminal!

Coinciding with this criminal accusation, there have been several other internet obstructors who treaten me for additionally suing Takenouchi though they are the ones who are harassing me and not I. (At least one of them is a friend of Ms. Ryoko Ando)

Within these 2 years, I have been harassed and threatened by countless number of internet obstructors and needed to block as many as 3000 accounts. 

(Most of them called me, "Demarin=Demagogue Mari" including ETHOS scholar Prof. Nobuhiko Ban who is actually leukemia development expert. Now increasing trend of acute leukemia is observed even outside of Fukushima.)

Some even said on twitter, "I will kill you," "Watch out for fire" "Go to Okinawa to suck Takenouchi's breast," "Takenouchi is a fraud since she is collecting donation for her activities."

Quite sadly, some are actually in anti-nuke citizen groups but they do not like my advocating actual health hazards among kids and they also spread groundless slanders against me.

Dear citizens of the world, I am calling for the following 2 things;

1. Please share this signature to pressure the Japanese government to evacuate Japanese kids and pregnant women from contaminated areas

Also, 

2. Please share this signature and call for bringing justice on harassers on citizens who worry about children's health risks in Japan.

福島事故後、私は福島から子供と妊婦を汚染地帯から疎開させることを自分の本やツイッターやブログを通じて呼びかけ、また国連にも直訴しました。（しかし今のところ何の効果もありません）
現在まで福島の子供は51人もが甲状腺がんの手術をしており、大変ショッキングなことにほとんどの子供がリンパ節や肺に転移していると言います。

 しかしながら日本政府は福島での一切の健康被害を否定し、その代り「放射線のせいで福島で鼻血が出ているという人がいるが、我々はこのような福島の復興を妨げる風評被害を抑制していかねばならない」と発言しています。

2014年1月、私は「線量計を持ちながら汚染地帯でもポジティブに暮らしていくことを推奨する福島のエートス」という団体の代表、安東量子氏（本名は鎌田陽子氏）から私のツイートが侮辱罪に当たると刑事告訴を受けました。

事故を起こした東京電力の幹部が誰一人として捜査もされない中、福島県警から3人、福島地方検察庁から2人、沖縄まで派遣されて捜査を受け、起訴猶予となりました。つまり私は犯罪者となる可能性を示唆されたのです。

ほぼ同時期に、ネット上での嫌がらせ者たちが竹野内をさらなる裁判にかけると、自分たちが私に嫌がらせをしながら脅しをかけてきています。(少なくともそのうちの一人は安東量子氏の友人です)

この2年間、私は数えきれないほどのネット上の人々から嫌がらせや脅しを受け、3000ものアカウントをブロックしなければなりませんでした。
(私をデマリンと呼び、その中にはエートスの学者で白血病発症メカニズムの権威でもある伴信彦教授も含まれます。現在福島以外でも病院統計で白血病の上昇が観察されています。)

ツイッターで酷いものになると「殺すぞ」「火事に気をつけろ」「竹野内の母乳を吸いに沖縄に行け」「活動費でカンパを集めている竹野内は詐欺師である」と言ったツイートも見られます。

大変残念なことに、反原発のグループの人でも、私が実際に起こっている健康被害を訴えることをなぜか嫌い、私に対して誹謗中傷する人々が散見されます。

世界市民の皆様、私は以下の2つを訴えます;

1. 日本政府に汚染地帯から子供と妊婦を避難させるよう圧力をかけるべく、この署名を拡散ください。

2. この署名を拡散し、日本の子供の健康被害を心配する市民に対する誹謗中傷者に対して正当な裁きが下されることを要求して下さい。

Mari Takenouchi appelle à l’évacuation des enfants de Fukushima

Mari Takenouchi vient de mettre en ligne une pétition internationale demandant l’évacuation des femmes enceintes et des enfants de Fukushima. Dans ce texte, la journaliste freelance rappelle les mensonges du gouvernement et les pressions qu’elle a elle-même subies depuis qu’elle dénonce les dangers de la vie en secteur contaminé. Elle réclame notre soutien.

Mari Takenouchi est une journaliste freelance japonaise. Depuis le début de la catastrophe nucléaire de Fukushima, elle couvre inlassablement les événements et cherche à alerter sur la situation des populations. Elle publie énormément sur Internet, notamment sur les blogs qu’elle a créés : Save Kids Japan, Mari Takenouchi's open questions, Shady People in Pro/Anti Nuke Societies, Ugly Japanese ou encore Mari Takenouchi’s Essay. Elle met aussi en ligne de nombreuses vidéos sur sa chaîne Youtube et diffuse des informations via ses comptes Twitter et Facebook. Une grande partie de son travail consiste à traduire des livres sur la radioactivité en japonais, mais aussi des témoignages de Japonais ainsi que ses propres articles en anglais, pour permettre une meilleure diffusion des informations à l’étranger et tenter d'alerter l’opinion internationale. Elle lutte inlassablement pour rompre le silence et protéger les enfants du Japon.

Protéger les enfants par l’information

Mère de famille et journaliste, Mari Takenouchi se consacre bénévolement à diffuser l’information concernant les risques liés à la catastrophe nucléaire de Fukushima. Elle se dit ouvertement anti-nucléaire. Son engagement devient un véritable combat lorsque le gouvernement japonais décide de relever la limite d’exposition à la radioactivité de 1 à 20 milliSievert par an. Cette décision, qui a pour conséquence directe de nier les conséquences sanitaires dues à l’accident nucléaire et de refuser toute évacuation de la population de certaines zones fortement contaminées, expose de fait d’innombrables adultes, mais surtout d’innombrables enfants et fœtus à des doses 20 fois supérieures à ce qui est autorisé dans le reste du monde. A ce moment précis, les enfants japonais sont condamnés à vivre dans des conditions équivalentes aux conditions de travail des employés du secteur nucléaire...

Pendant un temps, on laisse même planer le doute sur l’éventualité de relever la limite légale à 100 milliSievert par an… Nous sommes en avril 2011. Le Dr Shunichi Yamashita, président de l’association Japonaise de la Thyroïde, vient tout juste d’être nommé président de l’Université de Médecine de Fukushima et conseiller pour la gestion du risque sanitaire lié à la radioactivité dans la préfecture de Fukushima. Il n’hésite pas à se moquer ouvertement des parents qui s’inquiètent pour la santé de leurs enfants, à affirmer avec le plus grand sérieux que les gens qui sourient ne sont pas atteints par la radioactivité et qu’une dose de 100 microSievert par heure n’est pas dangereuse (ce qui correspond à 876 milliSievert par an)…

Mari Takenouchi comprend très vite que le gouvernement est en train de mettre en place une véritable stratégie de désinformation, qui ne fait qu’amplifier les conséquences de la catastrophe. Désormais, pour permettre aux résidents de se protéger, il va falloir se battre pour l’information. Ce constat est partagé par de nombreux autres activistes, et plus généralement par d’autres citoyens, qui vont spontanément s’organiser pour faire circuler l’information, organiser des manifestations, mettre en place des laboratoires indépendants, des centres d’analyse de la nourriture…

Et protéger les lanceurs d’alerte

Comme de nombreux journalistes indépendants, Mari Takenouchi a rapidement subi de multiples pressions. Reporters Sans Frontières dénonce d’ailleurs régulièrement ce fait, démontrant que nombres de ces intimidations sont le fait même du gouvernement. Un documentaire baptisé « Fukushima Censored » est d’ailleurs en cours de préparation. La tentative d’intimidation atteint son paroxysme en janvier 2014, quand Mari Takenouchi est poursuivie en justice pour un tweet qualifiant le projet Ethos « d’expérience sur des êtres humains ». Ce projet, financé par de grands groupes de l’industrie nucléaire française (EDF, CEA et Areva) et déjà mis en place à Tchernobyl, vise à apprendre aux populations à vivre en zone contaminée, en dépit de toute considération de sécurité sanitaire. La plainte n’a finalement pas abouti, mais elle a fait éclater au grand jour les pressions exercées à l’encontre de tous ceux qui osent s’inquiéter de la santé des populations exposées. Avant Mari Takenouchi, un autre journaliste indépendant, Minoru Tanaka, avait subi un acharnement judiciaire particulièrement violent pour son travail d’enquête sur la gestion de l’accident à la centrale nucléaire de Fukushima Daiichi.

On comprend mieux pourquoi la pétition lancée par Mari Takenouchi associe la nécessité de protéger les plus fragiles (en demandant l’évacuation des femmes enceintes et des enfants) et la défense de ce que nous appellerions les « lanceurs d’alerte ». Je vous invite à la signer, même si nous savons tous que ces pétitions sur Internet ne changent rien au final. Mais il y a derrière ce texte une femme, mère et journaliste, qui se bat depuis plus de trois ans, et qui a besoin de notre soutien. Ne lui laissons pas croire une seule seconde que nous acceptons cette situation ou que nous sommes indifférents à cette injustice…

Mon nom est Mari Takenouchi, traductrice spécialisée sur le nucléaire, journaliste freelance et mère célibataire d’un petit garçon de 4 ans.

Après l’accident de Fukushima, j’ai plaidé en faveur de l’évacuation des enfants et des femmes enceintes des zones contaminées de Fukushima dans mes livres, sur mon twitter et mon blog. J’ai même défendu cette cause auprès de l’ONU (mais sans grand résultat).

Actuellement, 51 enfants ont subis une opération du cancer de la thyroïde. Le plus effroyable est que la plupart avaient déjà des métastases dans leurs poumons et leurs ganglions lymphatiques.

Malgré tout, le gouvernement du Japon nie tout danger sanitaire à Fukushima et affirme plutôt : « Certains parlent de saignements de nez à Fukushima (cf. la polémique du manga Oishinbo) dus aux radiations. Nous devons contrôler ces rumeurs sans fondement qui peuvent être dommageable à la reconstruction de Fukushima ».

En janvier 2014, j’ai été outrageusement accusée pour mes tweets par Mme Ryoko Ando (son vrai nom est Yoko Kamata), la directrice du groupe nommée Fukushima ETHOS qui encourage les habitants à continuer de vivre positivement avec un dosimètre.

Alors qu’aucun dirigeant de TEPCO n’aura eu de mise en examen, 3 policiers de Fukshima et 2 membres du bureau du procureur de Fukushima ont fait tout le chemin pour enquêter sur moi à Okinawa allant jusqu’à me remettre une lettre d’inculpation ! Cela signifie que je pourrais être une criminelle !

Durant ces deux années, j'ai été harcelée et menacée par un nombre incalculable de gens sur internet et j'ai dû bloquer environ 3000 comptes. La plupart d'entre eux m'ont appelé Demarin (Démagogue Mari), y compris le professeur Nobuhiko Ban d'ETHOS, un expert sur le développement de la leucémie. Actuellement on observe une augmentation de leucémie même en dehors de Fukushima.

Certains m’ont également dit sur Twitter : « Je vais te tuer », « Fais attention au feu », «Va à Okinawa pour sucer les seins de Takenouchi », « Takenouchi est un imposteur puisqu'elle collecte des dons pour ses propres activités ».

Malheureusement, parmi ceux-là, certains font partie de groupes de citoyens anti-nucléaire mais n’apprécient pas que j’insiste sur les ravages causés à la santé de nos enfants, et ils propagent donc des rumeurs infondées à mon sujet.

Chers citoyens du monde, j’ai 2 souhaits :

1. S’il-vous-plaît, signez cette pétition pour pousser le gouvernement japonais à prendre ses responsabilités et évacuer les enfants et les femmes enceintes des zones contaminées de Fukushima
